BARRIE (CBS11) – After a three-week trial, a former Barrie firefighter is going to make his day in court.

The accused pleaded guilty to seven counts of second-degree murder for the 2004 murder of a man he called “Mr. D.”

Barry Shindell of Barrie pleaded guilty to eight counts of second-degree murder in the case.

He told court he was a rookie firefighter on the night of September 25, 2004, working the fire that killed the 37-year-old father of two.

Shindell told police “Mr. D” was sitting down at the fire station smoking a cigarette. Shindell said D took a swig, grabbed his wallet and went to enter the kitchen to use the restroom.

Shindell said the victim stood up, walked to the front of the kitchen and tried to grab his hand, Shindell said. But D moved the man’s hand from D’s hand and then he was shot.

Shindell had not seen the shooting but knew there was another man sitting in the kitchen. He remembers hearing a few gunshots and the man yelling that two other men had been shot.

The fire station had been burglarized by a drug addict, Shindell said.

Shindell told investigators that he used some of the money he made selling cigarettes as a down payment to buy a gun at the time. He said he intended to use the gun on D if he didn’t get the money back.

He said once D didn’t get the money back, he was going to kill D as well.

“It was an emotional time for me,” Shindell said at his court hearing Friday. “It was difficult, you know, for a while because I kept thinking, what do I do? Should I move my two children? Would it really be safe to keep this gun? And then I thought, what about the man? What would they do to him? Would he take their lives? Would they just be, you know, happy and go home knowing that his life is ended?”

After four days in court for pre-trial interviews in the case, Shindell was led away for an emotional sentencing hearing.
