A federal judge in Miami on Wednesday refused to rule on whether President Donald Trump’s order barring visitors from predominantly Muslim countries is unconstitutional.
Judge Demetrius Ramos ruled against the lawsuit, “The Deportation of Nefertiti” filed by the parents of a 9-year-old girl from Chad.
“You cannot have a program that is so indiscriminate, so broad, so sweeping and so arbitrary,” said Ramos, who said there were enough grounds to challenge the order.
Trump issued the executive order, also known as the “travel ban,” on January 27, restricting entry from seven Muslim-majority countries, the majority of which have no history of terrorism against the United States.
The case is being handled by the Miami-based Miami International Airport, the first federal court of appeal from the U.S. to do it.
The order was blocked by a court in Seattle in March, but the 9th Circuit Court of Appeals, which covers the western states, upheld the lower court
